I’ve had people asking when and if this would ever happen.
It did happen and now there are several systems immediately available to everyone in the Golden State.
Here is a quote straight from the manufacturers of the famous Berkey systems over at New Millennium Concepts, Ltd.:
“As you know we withdrew sales from the California marketplace when their lead free regulations went into affect.
“At that time it was our, as well as many other firms, opinion that the Lead Free regulations were too ambiguous, the requirements were too cost prohibitive and that the compliance requirements made it virtually impossible for small and medium sized companies, domiciled outside the state of California, to be in compliance.
“Since that time however, the state of California has defined with greater specificity the requirements pertaining to this regulation.
“In reviewing the updated information and after consulting with our counsel, we have come to the conclusion that Berkey free standing water filtration and purification systems do not fall within the scope of those regulations.
“It is important to note that California has other regulations that may affect some of our products.
“Until we have conducted a full review of those regulations, only sales of the following systems and products are now permitted to be made available to customers in state of California:”

More Information Regarding California Law
The state of California has made regulations for the sale of indoor water systems.
They require that any water system sold in the state be certified by an independent, third-party testing agency first.
This would include NSF, before the system can be considered for sale in California.
NSF Standard 42 (aesthetic effects) and Standard 53 (health effects) would specifically apply to our Black Berkey purification elements.
NSF Standard 42 covers systems designed to reduce specific aesthetic or non-health-related contaminants.
This includes chlorine, taste and odor, and particulates that may be present in public or private drinking water.
Berkey Certified Testing
The tests we have conducted are much more tougher than those required by NSF for the certifications mandated by the state of California.
Our filters have been tested by third-party independent labs. This is above standard of taste, odor, and chlorine reduction.
Although our testing is sufficient for 49 states in the US, it is currently not acceptable for people in the state of California.
In the end, Berkey has concluded that the additional taxes, certifications, and red tape have created too large of a barrier for our firm to offer our systems in the state of California.
